After a three day trial in the Bankruptcy Court for the Southern District of New York, Thomas H. Curran Associates’s managing partner Thomas H. Curran recently prevailed on a complaint to deny a debtor’s discharge under Section 727(a)(2) of the Bankruptcy Code. The case involved the debtor’s concealment of corporate assets legally owned by the debtor’s wife. The Bankruptcy Court held that the debtor possessed a beneficial and equitable interest in the corporation and its assets. The Court also found that the debtor’s concealment began more than ten years before the debtor filed his petition and continued into the one year period prior to his bankruptcy case.
