Akorn, a pharmaceutical company, has agreed to settle a whistleblower lawsuit for $7.9 million after allegedly submitting false claims to Medicare. After three prescription drugs became available over the counter between 2020-2021, Akorn continued selling the drugs with prescription labels in order to increase profits from Medicare reimbursement. Whistleblower Albermarle LLC, an entity formed for the purpose of bringing the lawsuit, will receive about $946,000.00 of the recovery.
Akorn continued to sell [over-the-counter drugs] with obsolete prescription labeling, resulting in false claims for reimbursement being submitted to Medicare.
